Cary Magazine Holiday Decorations Makeover Contest Rules

No purchase necessary. Void where prohibited. Some restrictions apply. One qualifier per household. You need not be present to win.

The sweepstakes: From 09/03/2010 through 09/17/2010, S&A Cherokee will promote, by means of the Web site www.carymagazine.com the opportunity to submit entries to win a grand prize as detailed below. Print, e-mail and other forms of advertising may also be used to promote the sweepstakes beginning 09/03/2010 through 09/17/2010.

Eligibility: In order to submit entries, persons of any age whose legal residence is the State of North Carolina shall be eligible to submit up to one entry per person. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for S&A Cherokee or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the contest or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. "Household members" shall mean people who share the same residence at least three months in one calendar year.

How to enter: (I) Complete and submit online one official entry form available at www.carymagazine.com on or before 09/17/2010, or (II) include requested information by S&A Cherokee on a plain 8½" by 11" piece of paper. Entries must be mailed to Cary Magazine’s Holiday Decorations Makeover, c/o 301 Cascade Pointe Lane, Cary, NC 27513. All sweepstakes entries become the property of S&A Cherokee and will not be returned and may be used by S&A Cherokee for any purpose and in any media in perpetuity.

How to win: The winner will be selected by our own panel of judges from all qualified entries on or about 09/17/2010. In the event that the original winner does not meet Official Rules or eligibility requirements, or he/she or parent or legal guardian forfeits the contest, S&A Cherokee will award the prize to the first alternate. Process will continue until the prize is awarded.

All entries must be received on or before 09/17/2010. The selection will be held the week of 09/20/2010. The decision of the judges and S&A Cherokee is final. The Contest winner will be notified by phone and/or mail and must meet all eligibility requirements.

By entering, each contestant agrees to be bound by the rules. S&A Cherokee, its promotional agents and contest co-sponsors are not responsible for illegible, lost, delayed or misdirected mail, errors in faxes or shipments, busy phone signals, or incomplete entries.

Grand Prize: (One) The Contest winner will receive the Holiday Decorations Makeover provided by the Container Store. An organization expert from the Container Store will then go to the winner’s home, diagnose the organizational dilemma, prescribe a storage solution, and perform a free holiday decorations makeover. Approximate total value of this grand prize is $500. There are no other prizes.

The Contest Prize is non-transferable. There may be no cash or other substitutions of prizes by winner. However, S&A Cherokee reserves the right to substitute similar prizes of equal or greater value in the event the above prize is unavailable for any reason. Individual, parent or legal guardian of winner is solely responsible for all applicable federal, state and local taxes with respect to entire prize.

Winner or Parent or legal guardian of Contest winner must sign an Affidavit of Eligibility, Release and Indemnification Form ("the Form") that : a) releases, indemnifies and holds harmless S&A Cherokee its parent, affiliated, subsidiary and successor companies, and its respective officers, directors, employees, agents, and representatives, advertising agencies and promotional sponsors (collectively the "Release") from and against any and all harm, expense, liability or injury that may be sustained relating to or arising from participation in the sweepstakes or acceptance or use of the prize; and b) authorizes the Releasee to use the winner’s names, likenesses, photographs, voices and biographical data for any purpose, in any media, unless prohibited by law.

Prize will not be released until S&A Cherokee receives all required documents. Failure of Contest winner to return the Forms within the required timeframe will result in automatic forfeiture of any prizes and all such prizes shall be awarded to an alternate winner. In the event of a prize forfeiture, the winner or parent or legal guardian of the winner forfeiting prize will sign a Prize Forfeit Form and return to S&A Cherokee within ten (10) days of receiving the Form.

The Contest winner agree to redeem these prizes the weekend of 09/27/2010 – 09/29/2010. S&A Cherokee is not responsible for making alternate arrangements for the redemption of these prizes.

Unforeseen Events: S&A Cherokee reserves the right to change this contest at its sole discretion at any time that S&A Cherokee become aware of any circumstances or occurrence which would materially affect the contest security or fairness. S&A Cherokee reserves the right to announce any contest rules changes over the air, in print or posters. S&A Cherokee is not responsible for the inability of the winner to accept the prize for any reason.
